Video: Dan Burnett on linking defamation case
In this video interview, UBC Graduate School of Journalism adjunct professor Dan Burnett explains the impact of the ruling by a Canadian court that linking does not amount to publication.
Prof Burnett was the lawyer for Jon Newton, the publisher of p2pnet.net, who was accused of defamation on the ground that his site contained links to allegedly defamatory material. But BC Supreme Court judge Stephen Keller dismissed the libel case, ruling that hyperlinks, are analogous to footnotes, and can not be consider a publication.
